Welcome to RareHouse Digital Productions. By accessing and using our website, services, and studio, you agree to comply with the following terms and conditions. Please read them carefully.

Acceptance of Terms

By using our services, you agree to be bound by these Terms and Conditions, along with our Privacy Policy and Studio Policies. If you do not agree, please refrain from using our services.

Services Provided

RareHouse Digital Productions offers photography, videography, studio rentals, and related services. Any additional services are subject to separate agreements.

Booking and Payments

  • All bookings must be made in advance and are subject to availability.

  • A non-refundable retainer is required to secure your booking.

  • Full payment is due before or at the time of service unless otherwise agreed.

  • Late payments may result in additional fees.

Cancellations and Refunds

  • Cancellations must be made at least 48 hours before the scheduled session to be eligible for rescheduling.

  • No refunds will be issued for no-shows or last-minute cancellations.

  • RareHouse Digital Productions reserves the right to cancel or reschedule bookings due to unforeseen circumstances.

Studio Usage and Conduct

  • Clients must adhere to all studio policies and guidelines.

  • Damages to studio equipment or property caused by the client will be the client’s financial responsibility.

  • We reserve the right to refuse service to anyone engaging in disruptive, disrespectful, or unsafe behavior.

Intellectual Property and Licensing

  • All content created by RareHouse Digital Productions remains our intellectual property unless otherwise agreed upon in writing.

  • Clients may not use, modify, or distribute media without proper licensing or permission.

  • Commercial usage of content requires a licensing agreement.

Privacy Policy

Your personal information is protected under our Privacy Policy. We do not sell or share your data with third parties without consent.

Liability and Indemnification

  • RareHouse Digital Productions is not responsible for any personal injury, property damage, or loss of belongings during sessions.

  • Clients assume all risks associated with their participation in our services.

  • By booking with us, you agree to indemnify and hold RareHouse Digital Productions harmless from any claims or disputes arising from your use of our services.

  • Clients acknowledge that RareHouse Digital Productions is not liable for any legal, physical, or financial damages resulting from their use of our studio or services.

  • Participation in any activities within the studio is at the client's own risk, and we do not accept liability for injuries, accidents, or unforeseen circumstances.

Payment & Chargeback Policy

  • All payments are final and non-refundable unless otherwise stated in our cancellation policy.

  • By booking a session, you agree to these terms and acknowledge that chargebacks and payment disputes are not permitted.

  • Clients book RareHouse Digital Productions because they appreciate our shooting style, retouching, and editing. Therefore, chargebacks should not be necessary.

  • In the event of an unauthorized chargeback, RareHouse Digital Productions reserves the right to pursue legal action and recover costs associated with the dispute.

  • If a chargeback is filed, we may ban future bookings and retain the right to withhold all images, videos, and deliverables until the matter is resolved.

  • Clients agree to first contact us with any payment disputes before initiating a chargeback with their financial institution.

  • We reserve the right to pursue collection for any additional fees incurred, including legal fees, processing fees, and any costs associated with recovering the disputed amount. By booking our services, you acknowledge and agree to these terms.

Model Release Agreement

By participating in a photo or video session with RareHouse Digital Productions, the Client and all individuals involved in the session (hereafter referred to as the "Model") grant RareHouse Digital Productions and its representatives the absolute and irrevocable right and permission to use, publish, and distribute photographs, video recordings, and other media captured during the session for commercial, promotional, advertising, portfolio, and any lawful purposes.

1. Grant of Rights

The Model acknowledges and agrees that:

  • The images and footage captured may be edited, retouched, and altered as necessary.

  • The media may be used in digital and print formats, including but not limited to websites, social media, promotional materials, advertising, and portfolios.

  • The Model releases all claims to financial compensation or approval rights related to the use of their likeness.

2. Ownership and Copyright

  • RareHouse Digital Productions retains full copyright and ownership of all images, videos, and related content created during the session.

  • Clients purchasing digital files or prints are granted personal usage rights but do not obtain ownership or copyright.

  • Commercial usage by the Client requires prior written consent from RareHouse Digital Productions and may be subject to additional fees.

3. Minors

  • If the Model is under the age of 18, the parent or whom ever booked the session is allowing RareHouse Digital Productions to use the images or footage as stated in the other following sections.

4. Revocation of Rights

  • The Model acknowledges that once images or footage are published, removal from public or promotional use is not guaranteed. Any special requests for removal will be reviewed on a case-by-case basis and may be subject to fees.

5. Liability & Indemnification

  • The Model agrees to release and hold harmless RareHouse Digital Productions, its owners, employees, and affiliates from any claims, demands, or causes of action arising out of the use of the media.

  • The Model confirms that they have voluntarily participated in the session and that their likeness is being used with their full consent.

By booking a session or participating in a production with RareHouse Digital Productions, the Client and Model acknowledge that they have read, understood, and agreed to this Model Release.

Changes to Terms and Conditions

We reserve the right to update these terms at any time. Clients will be notified of any significant changes.
